Use of the OpenAI API in selected products

OpenAI develops systems in the field of artificial intelligence and machine learning. Through the OpenAI API, our products can use functions that process text, requests, or other user-provided content automatically and generate responses, assessments, or recommendations based on such content.

The specific data processed depends on the function you use and on the content you enter, paste, upload, or submit for review. If you include personal data in such content, this personal data may also be processed and transmitted to OpenAI. Please do not enter or submit passwords, access codes, payment card details, identification documents, or any other unnecessary sensitive information.

Content transmitted to the OpenAI API is processed for the purpose of providing the respective requested function. According to OpenAI’s information, content submitted via the API or other business offerings is not used by default to improve or train OpenAI models, unless the API customer expressly opts in to such use.

Easy AI

Easy AI uses the OpenAI API to generate responses to your inputs and to perform the tasks you request. When you use Easy AI, the content you enter, paste, or otherwise provide for processing is transmitted to OpenAI so that your request can be processed and an appropriate response can be generated.

Depending on your use of the product, the following data may in particular be processed:

  • text entered or pasted by you
  • your request to the AI function
  • the response generated by the AI
  • technical metadata required to provide, secure, and troubleshoot the service

ScamCheck

ScamCheck uses the OpenAI API to analyse user-submitted content for possible indicators of scams, phishing, fraud, social engineering, or suspicious websites. The purpose of the AI analysis is to make warning signs easier to understand and to provide practical recommendations, for example whether a message should be ignored, blocked, not answered, or whether a link should not be opened.

When you use the AI analysis in ScamCheck, only the content that you actively submit for review, or that is technically required to perform the selected review function, is transmitted to OpenAI. Depending on the function used, this may in particular include:

  • pasted email texts
  • pasted SMS, WhatsApp, or messenger texts
  • URLs submitted for review
  • text recognised from screenshots
  • the respective analysis request
  • the response generated by the AI
  • technical metadata required to provide, secure, and troubleshoot the service

The submitted content may contain personal data if you include such information in texts, URLs, emails, messages, or screenshots. Please do not submit passwords, payment card details, access codes, identification documents, or any other unnecessary sensitive information.

Purpose of processing

The processing is carried out in order to provide the respective AI-powered function. In Easy AI, this serves in particular to respond to your inputs and to perform the tasks requested by you. In ScamCheck, this serves in particular to analyse submitted content, identify potential indicators of fraud or phishing, and generate understandable risk assessments and recommendations for action.

Avoiding data transmission

You can avoid the transmission of content to OpenAI by not using the respective AI-powered functions or by not submitting any content for analysis. In ScamCheck, you may also cancel an analysis or, where available in the app, withdraw any consent previously given in the settings.

Storage period

Abelssoft does not permanently store the content transmitted to the AI functions unless storage is technically necessary to provide the service, troubleshoot errors, prevent misuse, or comply with legal obligations.

OpenAI may process and temporarily retain API data in accordance with the applicable terms, agreements, and data retention policies, in particular for the purpose of providing, securing, troubleshooting, and monitoring the service for abuse. According to OpenAI, the general OpenAI Privacy Policy does not apply to content that OpenAI processes on behalf of customers through business offerings such as the API; such processing is governed by the applicable customer agreements.

Legal basis

Where consent is required for the use of individual AI-powered functions, the processing is carried out on the basis of your consent pursuant to Article 6(1)(a) GDPR.

Where the processing is necessary to provide the function requested by you, the processing may, depending on the individual case, also be carried out for the performance of a contract pursuant to Article 6(1)(b) GDPR.

In addition, the processing of technically required data may be based on our legitimate interest pursuant to Article 6(1)(f) GDPR in providing our products securely, reliably, and properly, preventing misuse, and troubleshooting errors.

Transfers to third countries

In connection with the use of the OpenAI API, the processing of personal data by OpenAI or affiliated entities outside the European Union or the European Economic Area cannot be excluded. Where personal data is transferred to third countries, such transfer is carried out in accordance with the applicable data protection laws and on the basis of appropriate safeguards, in particular contractual arrangements and, where required, standard contractual clauses.
